Terms of Service
Last updated: 14 June 2026
Please read these Terms of Service carefully before using Eleva Wellbeing. By accessing or using our website, or by joining our waitlist, you agree to be bound by these Terms. If you do not agree, please do not use the service.
1. About Eleva Wellbeing
Eleva Wellbeing is operated by Eleva Wellbeing Ltd, a company registered in England and Wales.
Today, Eleva Wellbeing is available as a public website and a waitlist at elevawellbeing.app. The Eleva Wellbeing mobile app, a digital mental wellbeing product offering personalised daily micro-interventions, emotional check-ins, progress tracking, and signposting to professional care resources, is in development and is not yet available. The sections below that describe the app and its features will apply when the app launches. The waitlist terms in Section 4 apply now.
Important: what Eleva Wellbeing is not
Eleva Wellbeing is not a medical device. It is not a crisis service. It is not a substitute for professional mental health care, therapy, or medical advice. The tools and features planned for the app, including the PHQ-9 and GAD-7 screening tools, are provided for informational and wellbeing support purposes only and do not constitute clinical diagnosis, clinical treatment, or medical advice.
If you are experiencing a mental health emergency, please contact the emergency services (999 in the UK) or a crisis helpline (Samaritans: 116 123, available 24/7).
2. Eligibility
You must be at least 18 years of age to use Eleva Wellbeing or to join the waitlist. By using Eleva Wellbeing, you confirm that you are 18 or older. The service is intended for adults based primarily in the United Kingdom. If you are located elsewhere, additional terms may apply.
3. The Website and Future Accounts
You may browse the website and join the waitlist without an account. Accounts will be introduced with the Eleva Wellbeing app. When accounts become available, you will be asked to provide accurate registration details, to keep your credentials secure, and to accept responsibility for activity under your account, and we may suspend or terminate accounts that breach these Terms.
4. Waitlist and Referral Programme
Joining the waitlist registers your interest in Eleva Wellbeing. It does not create an account, and it does not guarantee access to, or any particular pricing or features of, the future app.
- We will send you a one-off email to confirm your email address, a one-off confirmation email containing your personal referral link, and, when early access opens, your invite or access instructions. These are service messages, not marketing.
- You may share your referral link with others. The referral page may describe reward or recognition tiers, for example earlier access or founding-supporter recognition. Any such rewards are indicative, are not guaranteed, and may change.
- We may modify, pause, or withdraw the waitlist or the referral programme at any time, and we may disqualify referrals that we reasonably believe are fraudulent, automated, or otherwise abusive.
- No purchase is necessary, and the referral programme has no cash value.
- You can leave the waitlist at any time by emailing support@elevawellbeing.com. See our Privacy Notice for how we handle waitlist data.
5. Use of the Service
5.1 Permitted Use
You may use Eleva Wellbeing solely for your personal, non-commercial purposes in accordance with these Terms.
5.2 Prohibited Use
You agree not to:
- Use the service for any unlawful purpose or in breach of applicable law
- Attempt to gain unauthorised access to any part of the service or its infrastructure
- Upload, transmit, or share content that is harmful, offensive, abusive, or misleading
- Use the service in any way that could damage, disable, or impair it, including automated abuse of our forms
- Reverse engineer, copy, or attempt to extract source code from any part of the service
- Use the service on behalf of a third party without their consent
6. Clinical Screening Tools (Planned for the App)
When the app launches, it will incorporate validated clinical screening instruments, specifically the Patient Health Questionnaire-9 (PHQ-9) and the Generalised Anxiety Disorder Assessment-7 (GAD-7), as part of its wellbeing check-in feature. These tools are not part of the current website or waitlist.
When the app is available, you acknowledge and agree that:
- These tools are used for informational and wellbeing tracking purposes only
- Their use does not constitute a clinical diagnosis or clinical assessment
- Results are not shared with healthcare professionals unless you choose to do so
- If your scores indicate that you may benefit from additional support, the app will signpost you to appropriate professional resources, and this signposting does not constitute a referral or clinical recommendation
- You should always seek professional advice from a qualified healthcare provider if you have concerns about your mental health
7. Escalation Pathway (Planned for the App)
When the app launches, it will include a structured signposting feature that may be activated when certain thresholds are detected in your check-in data, guiding you towards appropriate professional resources such as GP services, therapist directories, or crisis helplines. This feature:
- Is not a substitute for emergency services. If you are in immediate danger, call 999.
- Does not involve real-time human monitoring of your data by Eleva Wellbeing staff
- Does not constitute a clinical referral or emergency intervention
- Is intended as a compassionate prompt to seek professional support when your data suggests it may help
If you are in crisis, please contact: Samaritans (116 123, free, 24/7), Crisis Text Line (text SHOUT to 85258), NHS 111, or the emergency services (999).
8. Intellectual Property
All content, features, and functionality of Eleva Wellbeing, including text, graphics, exercises, audio content, clinical frameworks, and software, are owned by or licensed to Eleva Wellbeing Ltd and protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.
9. Data and Privacy
Your use of Eleva Wellbeing is governed by our Privacy Notice and Cookie Policy, which explain how we collect, use, and protect your personal data and the legal bases on which we rely. We do not rely on these Terms as your consent to data processing. Where we need your consent for a specific purpose, for example to process special category health data in the future app, we will ask for it separately, and you may withdraw it at any time.
10. Disclaimers and Limitation of Liability
10.1 No Warranty
Eleva Wellbeing is provided on an 'as is' and 'as available' basis. We make no warranties, express or implied, regarding the accuracy, completeness, reliability, or fitness of the service for any particular purpose.
10.2 Limitation of Liability
To the maximum extent permitted by applicable law, Eleva Wellbeing Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or damage to health, arising out of or in connection with your use of the service.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under English law.
10.3 Mental Health Disclaimer
Eleva Wellbeing is a wellbeing product. It is not designed to replace professional mental health services. We strongly encourage you to seek qualified professional support for any significant mental health concerns. We accept no liability for any outcome resulting from reliance on the service as a substitute for professional care.
11. Changes to the Service and Terms
We may update these Terms from time to time. Where changes are material, we will say so on the website or by email. Continued use after we notify you constitutes acceptance of the revised Terms. We may modify, suspend, or discontinue any part of the service.
12. Termination
You may stop using Eleva Wellbeing at any time. We may suspend or terminate your access if you breach these Terms or if we reasonably believe your use poses a risk to you or others.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any dispute arising under or in connection with these Terms is subject to the exclusive jurisdiction of the courts of England and Wales.
